Minor Subdivision

What is a minor subdivision?  A subdivision is considered minor when all of the following conditions exist:

  • There is no public right-of-way dedication; and,
  • The entire tract to be subdivided is ten (10) acres or less in size; and,
  • The resultant subdivision will produce ten (10) or fewer lots.

Can I subdivide my property? 
Yes, you can subdivide your property if it meets zoning requirements.  In determining if your property can be subdivided you will need to find out what your property is zoned.  Different zoning districts will have different minimum  requirements such as lot frontage, width, size and density.  You may find your zoning as follows:

  • View the Land Development Map.
  • Look up your property on the county website.
  • Contact the Town of Cornelius Planning Department at 704-896-2461.

Once you know what your property is zoned you can find out the zoning requirements by viewing the zoning district requirements in Chapter 5 of the Land Development Code.

It is important to remember that any subdivision of land cannot create a nonconforming lot or a flag lot.

How do I file a minor subdivision request? 
Chapter 12 of the Land Development Code charts the plan review process.  The steps required are as follows:

  • Prior to filing your request, you should meet informally with a member of Planning Staff to discuss the proposed subdivision.
  • You will need to submit a  Cornelius Land Development Application, fee (checks can be made to the Town of Cornelius) and 3 copies of the plat of the  proposed subdivision.
  • Staff will review the plans and return them with comments to the applicant.
  • Site engineer or surveyor makes necessary revisions.
  • Applicant resubmits 3 mylar plats to Cornelius Planning Department for signature.
  • Applicant files plans with Register of Deeds.
  • Applicant returns one mylar and 12 paper copies of the recorded plat to Cornelius Planning Department.
  • Certain requirements apply for condominiums and subdivisions for conveyance purposes only.  Ask the Planning Staff about these special circumstances.

How much will it cost? 
The Town of Cornelius charges a fee of $50.00 for minor subdivision plat review.  There may also be certain street improvements required including trees and sidewalks.  The Register of Deeds  (704-366-2443), Mecklenburg County (704-432-2520) or any other agencies involved will impose their own fees.

How long will it take? 
Completion of a minor subdivision plat is approximately a 1 to 2  week process from the time the plat is submitted to the Planning Department.  If construction drawings are necessary they are submitted separately and are part of a separate approval process.
